Welcome to SoberBuddy Corporation’s Digital Platforms. By accessing and using our website, the SoberBuddy Community App, and the SoberBuddy Sober Tracker App (collectively referred to as “Services”), you agree to comply with and be bound by the following terms and conditions of use (“Terms of Use”), which together with our Privacy Policy govern SoberBuddy Corporation’s relationship with you in relation to these Services.

The term “SoberBuddy Corporation” or “us” or “we” refers to the owner of the Services whose registered office is 4041 MacArthur Blvd. 4th floor, Newport Beach, CA 92660. The term “you” refers to the user or viewer of our Services.

Subscription Options (Applicable to SoberBuddy Community App and SoberBuddy Sober Tracker App)

  • We offer monthly and yearly subscription options at variable prices. By subscribing, you agree to pay the subscription fee in accordance with the subscription option you have chosen.

Payment Terms (Applicable to SoberBuddy Community App and SoberBuddy Sober Tracker App)

  • Payment will be charged to your account on a monthly or yearly basis depending on the subscription option you have chosen. The subscription will automatically renew unless you cancel your subscription at least 24 hours before the end of the current subscription period. We reserve the right to change the subscription fee at any time, but we will notify you in advance of any changes.

Cancellation and Refund Policy

  • You may cancel your subscription at any time through the medium you used to subscribe. For example, if you subscribed in the iTunes or Google Play store, you would cancel there, but if you subscribed on the website at community.yoursoberbuddy.com,, you would unsubscribe there. If you cancel your subscription before the end of the current subscription period, you will not be refunded for any unused portion of the subscription. We do not offer refunds or credits for partial subscription periods or unused services.

Intellectual Property

  • The content of these Services, including but not limited to text, graphics, logos, images, and software, is the property of SoberBuddy Corporation or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, transmit, or use the content of these Services for any commercial or public purpose without the prior written consent of SoberBuddy Corporation.

Disclaimer of Warranties and Limitation of Liability

  • These Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. SoberBuddy Corporation does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components. In no event shall SoberBuddy Corporation be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use these Services, even if SoberBuddy Corporation has been advised of the possibility of such damages.

Governing Law and Jurisdiction

  • These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding arising out of or in connection with these Terms of Use or your use of these Services shall be brought exclusively in the federal or state courts located in Orange County, CA, and you consent to jurisdiction and venue in such courts.

User Conduct (Applicable to all Services including SoberBuddy Community App and SoberBuddy Sober Tracker App)

  • By using these Services, you agree not to engage in any conduct that could harm SoberBuddy Corporation, its affiliates, or other users of the Services. This includes, but is not limited to: sharing confidential information you learned in a community meeting, sharing the identities of other users with those outside the community, selling or soliciting users for drugs or alcohol, intentionally triggering users of the community to use alcohol or drugs, intentionally implanting viruses into the technology, hacking into user information, gathering or stealing user data, imitating another user in the community, recruiting the community for your own financial gain, recruiting the community to another app or product. 

Indemnification

  • You agree to indemnify and hold SoberBuddy Corporation, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of these Services or your violation of these Terms of Use.

Termination

  • SoberBuddy Corporation reserves the right to terminate your access to these Services or your subscription at any time and for any reason, including but not limited to your breach of these Terms of Use. Upon termination, you must immediately cease all use of the Services and destroy any materials obtained from the Services.

Modification of Terms of Use

  • SoberBuddy Corporation reserves the right to modify these Terms of Use at any time without prior notice. Your continued use of the Services after any changes to the Terms of Use constitutes your acceptance of the revised Terms of Use.

Entire Agreement

  • These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and SoberBuddy Corporation regarding your use of our Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and SoberBuddy Corporation.
